By purchasing products from Nugget Farm And Hatchery, LLC, you agree to the following terms and conditions.

1. General Terms

These Terms of Sale govern all transactions between Nugget Farm And Hatchery, LLC ("Seller") and the buyer ("Buyer"). By placing an order, you accept these terms.

2. Product Information

We strive to display accurate product information. However, we reserve the right to:

Correct pricing errors
Update product descriptions without notice
Limit quantities at our discretion

3. Pricing and Payment

All prices are in US Dollars (USD)
Payment must be received before order processing
We accept major credit cards and other payment methods as displayed

4. Shipping and Delivery

Shipping costs are calculated at checkout
Delivery times are estimates and not guaranteed
Risk of loss transfers to buyer upon delivery to carrier
We ship to addresses within the continental United States

5. Live Bird Orders

Live birds are shipped via appropriate carriers
Health guarantees apply to live arrivals
Pre-orders may be required for certain items

5a. Hatching Eggs & Shipped Eggs

Important: Nugget Farm And Hatchery, LLC cannot guarantee hatch rates on shipped hatching eggs. Once eggs leave our facility, numerous factors beyond our control can affect hatchability, including but not limited to:

Temperature fluctuations during transit
Handling by shipping carriers
Postal delays and extended transit times
Rough handling during shipping
Environmental conditions at various points during transit

We carefully package all hatching eggs to maximize protection and fertility. However, we cannot control conditions once the package is handed to the carrier.

Damaged Shipment Policy: If hatching eggs arrive broken or damaged during shipping, we will replace them or issue a full refund upon receipt of photos of the damaged eggs and packaging. Contact us within 24 hours of delivery.

We strongly recommend local pickup at our farm in Newberry, MI for the best hatch rates.

By purchasing shipped hatching eggs, buyer acknowledges and accepts these conditions.

6. Limitation of Liability

Seller's liability shall not exceed the purchase price of the product. Seller is not liable for indirect, incidental, or consequential damages.

7. Governing Law

These terms are governed by the laws of the State of Michigan. Any disputes shall be resolved in Luce County, Michigan.
